			<content:encoded><![CDATA[<p>In Quebec, thieves working in the dead of night made away with sections of roofs, gutters, and wiring made of copper from four Quebec City churches. In metro Atlanta, Georgia, reports of air conditioning thefts from a few home and commercial sites are cause for concern. Meanwhile, mobile phone base station equipment has been destroyed as the result of theft of the copper wire and feedline. This widespread problem of metal theft has had a significant impact on the recycling industry and other businesses whose supplies or equipment have been deemed valuable by unscrupulous individuals looking to cash in on the rising price of metal.</p>
<p>In fact, the increased price of stainless steel has brought a shared problem for two diverse, and seemingly unrelated, industries: scrap recyclers and beer distributors. As the scrap value of kegs has become higher than the deposit, thieves, dishonest consumers and, in some cases, retailers, have redeemed the metal barrels at scrap recycling yards instead of returning them to the rightful owners. In 2007, beer makers say they lost hundreds of thousands of kegs and millions of dollars as the stainless steel holders of brew are stolen and sold for scrap.</p>
<p>The problem can be twofold as keg-buying customers opt to forgo their deposits, which can range from $10 to $30, knowing they can cover that expense, and then some, if they sell to scrap dealers. Given current metal trading prices, a keg could fetch from $15 to $55 or more at scrap yards.</p>
<p>&#8220;Beginning in 2005, we started noticing a pronounced loss of kegs during our annual audit by Anheuser-Busch,&#8221; explained Mike Dowd, Vice President and General Manager for CITY Beverage-Markham. &#8220;Distributors are billed for the missing kegs. CITY Beverage was not alone in the significant funds we expended to replace the stolen kegs. It is an industry-wide problem.&#8221;</p>
<p>Roger Bushnell, Ferrous Processing &#038; Trading&#8217;s (FPT) Vice President of Non - Ferrous Metals, learned of this concern soon after it developed. &#8220;Because of our relationship with sister companies CITY Beverage and Kalamazoo Beer Distributing, FPT quickly became involved in spreading awareness to our industry. The wide - ranging portfolio of companies&#8217; allowed us to gain knowledge of the growing number of keg thefts early on.&#8221;</p>
<p>Industry associations have now joined together to actively deter the illegal practice. In July 2007, the Beer Institute, the Institute of Scrap Recycling Industries, Inc., and the Brewers Association issued a joint letter to recyclers with the simple message: &#8220;Don&#8217;t accept beer kegs at your facility.&#8221; The letter also provided window stickers warning would - be thieves that beer kegs should be returned to local beer wholesalers or retailers.</p>
<p>&#8220;If there is no available market, the kegs will be returned to the retailer, and ultimately, the distributor,&#8221; noted Bushnell. In Michigan, brewers were recently allowed to raise the keg deposit and the market is correcting itself. Illinois legislators have passed a bill that becomes law on August 18, 2007 making it illegal for scrap recyclers to accept kegs.</p>
<p>&#8220;All kegs are stamped with the owners&#8217; name. Anyone attempting to redeem them will have to prove ownership,&#8221; detailed Dowd. &#8220;This new law will help us to get our arms around this problem.&#8221;</p>
<p>Sister company FPT is doing its part to stop the unwelcome practice. &#8220;Our ongoing and historical policy is not to accept kegs,&#8221; Bushnell firmly noted.</p>

			<content:encoded><![CDATA[<p>Some of the highest paid employees in the country relative to their skill, education and knowledge are service workers that regularly receive tips.  Dancers, waiters, waitresses, and bartenders often earn more than professionals including nurses and lawyers.  It is not uncommon for a bartender to earn $80,000 a year or a dancer to earn $200,000 a year.  </p>
<p>      Often this leads to business managers and owners to take tip income from these workers and redistribute it or pocket it, or as a basis to set up a compensation system that does not comply with the labor code.  Some employers pool tip income and distribute to all employees, some distribute on the basis of categories of jobs, and some include all employees.  Some employers may attempt to use tip income in determining if the employee is getting paid minimum wage. </p>
<p>	California law regulates gratuity and income and specifies what type of actions are prohibited. The California Division of Labor Standards Enforcement defines the term &#8220;gratuity&#8221;as follows. &#8220;Gratuity&#8221; includes any tip, gratuity, money, or part thereof, which has been paid or given to or left for an employee by a patron of a business over and above the actual amount due such business for services rendered or for goods, food, drink, or articles sold or served to such patron. Any amounts paid directly by a patron to a dancer employed by an employer subject to Industrial Welfare Commission Order No. 5 or 10 shall be deemed a gratuity.   It defines the term &#8220;Business&#8221; as meaning  any business establishment, or enterprise, regardless of where conducted.  </p>
<p>	The courts consistently have held that they will defer to the regulations established by such agencies as the Division of Labor Standards Enforcement and therefore the regulations are substantially law.  Occasionally the court will reverse a DLSE order, but that is very rare.</p>
<p>	The DLSE specifically states that:<br />
	No employer or agent shall collect, take, or receive any gratuity or a part thereof, that is paid, given to or left for an employee by a patron, or deduct any amount from wages due an employee on account of a gratuity, or require an employee to credit the amount, or any part thereof, of a gratuity against and as a part of the wages due the employee from the employer.  Every gratuity is hereby declared to be the sole property of the employee or employees to whom it was paid, given, or left for. An employer that permits patrons to pay gratuities by credit card shall pay the employees the full amount of the gratuity that the patron indicated on the credit card slip, without any deductions for any credit card payment processing fees or costs that may be charged to the employer by the credit card company.  Payment of gratuities made by patrons using credit cards shall be made to the employees not later than the next regular payday following the date the patron authorized the credit card payment. </p>
<p>	The DLSE and the Labor Code specifically prohibit employers and their agents from taking, sharing, or receiving tip money left for employees. The term agent has been defined as every person other than the employer having the authority to hire or discharge any employee or supervise, direct, or control the acts of employees. </p>
<p>	Tip pooling policies where waiters, waitresses, busboys, and bartenders share in the tips is deemed to be legal, because it is a long-standing practice in the restaurant industry.  This was the opinion in the case of Leighton v. Old Heidelberg, Ltd., 219 Cal.App.3d 1062 (1990), but it was a split decision and may change in the future if appealed in a different district, but for now it is the law.</p>
<p>	 The DLSE also issued and opinion letter in 2005 , where it  interpreted Labor Code section 351 to allow for a tip pool policy requiring the employee receiving the tip to contribute 15% of the actual tips to the tip pool and all money from the tip pool then to be distributed to the other employees in the &#8220;chain of service&#8221; based on the number of hours they worked, as is consistent with industry custom, provided: </p>
<p>	1) Tip pool participants are limited to those employees who contribute in the<br />
	chain of the service bargained for by the patron, pursuant to industry custom<br />
	[examples of employees included in &#8220;chain of service&#8221; provided in Opinion Letter],<br />
	 and </p>
<p>	2) No employer or agent with the authority to hire or discharge any employee<br />
	or supervise, direct, or control the acts of employees may collect, take or receive<br />
	any part of the gratuities intended for the employee(s) as his or her own.  </p>
<p>	The DLSE also prohibits employers from making wage deductions from gratuities, or for using gratuities as direct or indirect credits against the employee&#8217;s wage and it also  specifically disallows a recovery of credit card charges incurred by the employer. </p>
<p>	Under federal law and employer can have an employment agreement with the employee that would allow an employer to employ so-called &#8220;tip credits&#8221; against wages owed to an employee, but the practice is illegal under California law.</p>
<p>	California law requires every employer  keep accurate records of all gratuities received by him, whether received directly from the employee or indirectly by means of deductions from the wages of the employee or otherwise.  Such records shall be open to inspection at all reasonable hours by the DLSE. The employer to keep accurate records of any gratuity received by him through any means including credit cards and because of the requirement the burden of proof regarding amounts due em ployees from credit card charges would be on the employer.<br />
The Court of Appeal held that any cost of doing business must be borne by the employer and not the employee. Inasmuch as credit card purchases are common, the cost of credit card charges are a cost of doing business. Thus this decision had been interpreted by DLSE to prohibit any deduction from the wages of employees by the employer to recover costs incidental to tips left for employees. </p>
<p>	Sometimes employers attempt to get around these rules and pocket a large chunk of the tips by categorizing the employee as an independent contractor and renting space to the employee or setting some sort of an arrangement where the employee pays the employer instead or purchases supplies from the employer.  The DLSE and the courts have both defined the characteristics of an independent contractor and these arrangements, rarely work, because the employee is an employee and not an independent contractor.</p>

More and more businesses are opting for the middle-road: a custom software solution that will provide the appropriate mix of flexibility, price, and power.</p>
<p>The Trade-off between Scalability and Flexibility<br />
Microsoft Excel and other off-the-shelf (OTS) or consumer grade applications, such as Access, are very flexible in the way they manage data. They are agnostic as to the specific types of data stored and arranged, and create a number of generic tools available for mining and manipulating data.</p>
<p>Alternatively, high-end, typically industry vertical-specific applications are inflexible as to the type of data, where and how the data is stored and which operations are available to manipulate and explore data. However, by trading flexibility for scalability, these high-end solutions are able to perform complex manipulation and reporting efficiently on very large quantities of data.</p>
<p>The Trade-off between Power and Price<br />
With a higher degree of scalability and processing power comes a hefty price tag. The initial license cost cast be tens of thousands of dollars per license; annual maintenance and upgrade fees can easily reach 40% of the original purchase price; and the lost productivity and costs of integrating the new software into a company&#8217;s unique business situation can easily double or triple the explicit purchase and installation price.</p>
<p>Additional ongoing costs include keeping staff up-to-date on the new functionality of the latest release, and paying high-priced vendor consultants to enable your expensive piece of software to do what you need to run your business. Consumer grade or retail software can cost hundreds of dollars per user without a fixed maintenance fee.</p>
<p>They usually have major feature upgrades priced at 50 to 75 percent of the cost of a new license. In return for reduced up-front licensing and implementation cost, however, retail consumer software suffers from performance issues when either the sheer amount of data overwhelms the entry-level installation, or when the custom needs of the user exceed the design of the off-the-shelf product. </p>
<p>The Custom Software Solution<br />
Businesses seeking a rich feature set without the large price tag must consider custom software. Custom software prices are typically negotiated based on your needs and wants, and on the complexity of the finished application. Custom software combines the functionality of both off-the-shelf and high-end software packages but allows the features to be tailored to the needs of the customer.</p>
<p>The customer defines documentation requirements, functional requirements, and technical support procedures modified to his or her business process and existing IT infrastructure.  Custom software can be a pay-as-you-go pricing model, where you only pay for what you need, and since you are buying customized functionality, you get a very powerful vertical application at a comparatively low price.</p>

Regardless of the what type of business you run there is a need to keep records for decision making and to comply with federal and state laws.  Every business is in the business of record keeping and failure to do so, can come back to bite you.  </p>
<p>	Keep track of the compensation paid to employees is no exception.  Often employers to try to avoid having to pay taxes and having to comply with minimum wage, overtime, and meal period laws.  Sometimes employers keep records, but then destroy them when a claim or audit is made.  Some employers go as far as keeping multiple sets of records to avoid prosecution or liability.  Unless exempted every employer is required to keep records under federal law, so it does not matter what state you have your business, under federal law you are required to keep records.  The records are to be of the person employed, the wages, hours and other conditions and practices of employment and required to be preserved for a specified time.   </p>
<p>	The terms of the records very depending on what information is kept.  Payroll records must include the employee&#8217;s name, address, occupation, hours worked each day and each week; wages paid and the date of the payment, the amounts earned as straight time and the amounts earned as overtime; and the deductions.  These payroll records must be kept for a period of three years.  This does not mean you can destroy payroll records after three years, because the statute of limitations for your state may be longer than three years or your state record keeping requirements may be longer.  Federal law also requires that plans, trusts, collective bargaining agreements, employee notices, and sales and purchase records be kept for a period of three years.</p>
<p>	The basic time and earnings cards for employees are required to be kept for a period of two years.  Wage rate tables and work schedules are also required to be kept for a period of two years.  This is federal law and applies to all states.  Federal law also requires that records for order, shipping, and billing be kept for two years.  Lastly any records of additions to or deductions from wages be kept for a period of two years.</p>
<p>	Some employers who knowingly are not paying minimum wage, or overtime often destroy these records at the first sign of a lawsuit.  This does not protect the employer and can result in greater damages to the employer.  The employee meets the burden of proof by oral testimony.   The employee is not required to prove the precise hours or wages owed by the employer.  The burden is on the employer to prove that the employer has complied with the law.  The employer may be tempted to fabricate records or destroy records to protect its interests.  These activities can lead to sanctions, in the form of fines, or rulings in favor of the employee.  Intentional destruction or fabrication of these records can lead to criminal prosecution and if found guilty the actors can be sentenced to prison.  The crime is a felony and therefore the punishment can mean more than one year in prison.  </p>
<p>	Corporations are used to avoid personal liability and in the past were effectively used to avoid all types of liability, but corporations cannot be used to avoid complying with labor laws.  Under federal law the federal courts have found that an employer cannot avoid liability for labor laws by incorporating.  The officers and primary shareholders can still be found liable, so destroying or fabricating records can lead to personal liability not only for money damages, but also for criminal prosecution.  </p>
<p>	State laws vary, but impose further record keeping requirements.  California also requires that the ages of any minors working be recorded and kept for a period of four years.  Under California law an employee can claim up to four years of overtime or meal and rest period violations.  So it is advisable than an employer maintain records for a period of at least four years.  </p>

than most occupations. Doctors have also never been under greater pressure nor been more concerned for the future of the NHS.</p>
<p>Before starting medicine you really do need to think about what lies ahead. The trouble is that it is almost impossible to understand fully what the profession demands, particularly during the early years of postgraduate training, without actually doing it.</p>
<p>Becoming a doctor is a calculated risk because it may be at least five or six years hard grind before you begin to discover for sure whether or not you suit medicine and it suits you. And you may change; you might like it now, at your present age and in your current frame of mind, but in six years time other pressures and priorities may have crowded into your life. </p>
<p>Medicine is both a university education and a professional training. The first five or six years lead to a medical degree, which becomes a licence to practise. That is followed by at least as long again in practical postgraduate training. The medical degree course at university is too long, too expensive (about 200 000 in university and NHS costs, quite apart from personal costs), and too scarce an opportunity to be used merely as an education for life.</p>
<p>It might seem odd not to start considering medicine or not by weighing up academic credentials and chances of admission to medical school. Not so; of course academic and other attributes are necessary, but there is a real danger that bright but unsuited people, encouraged by ambitious schools, parents or their own personalities, will go for a high profile course like medicine without having considered carefully first just where it is leading. </p>
<p>A few years later they find themselves on a conveyor belt from which it becomes increasingly difficult to step. Could inappropriate selection of students (most of whom are so gifted that they almost select themselves) account for disillusioned doctors? Think hard about the career first and consider the entry requirements afterwards.</p>
<p>Why do people want to become doctors? Medicine is a popular career choice for reasons perhaps both good and not so good. And who is to say whether the reasons for going in necessarily affect the quality of what comes out?</p>
